What Is an SHM in Bali? Freehold Title Explained for Foreigners (2026)

SHM stands for Sertifikat Hak Milik, the certificate of the Right of Ownership, and it is the strongest freehold title in Indonesia. It is also the one most foreign buyers ask for by name. The catch is the part the marketing rarely leads with: SHM is reserved for Indonesian citizens, and a foreigner cannot hold SHM directly. If someone offers you "freehold in your own name" on a Bali villa, that phrase is doing a lot of quiet work.

Anteya observation: roughly one in four serious buyers raises "freehold in my name" within their first few messages, and it is one of the most frequent openers on Uluwatu and Bingin inquiries. The title that satisfies that demand for a foreigner is usually not SHM.

What an SHM actually is

Hak Milik is the fullest bundle of land rights Indonesian law grants: perpetual, inheritable, transferable, and usable as mortgage collateral. The certificate proving it is the SHM. When Indonesians talk about owning land outright, this is the title they mean.

Two features make it the benchmark. It never expires, so no clock runs toward a renewal negotiation, and it is the cleanest title to mortgage or resell. The constraint is written into the framework itself: under Indonesia's Basic Agrarian Law (Law No. 5 of 1960), Hak Milik can be held only by Indonesian individuals.

Why a foreigner cannot hold SHM directly

The restriction is about citizenship, not money, residency, or years lived on the island. A foreigner with a KITAS, a business, and a decade in Canggu is still outside the class of people who may hold Hak Milik.

So any Bali listing sold to a foreigner as "freehold" is either using the word loosely, to mean a long extendable lease, or pointing at a structure that holds the SHM through an Indonesian party. The honest question is not "is it freehold?" but "what title do I actually hold, and in whose name?"

The routes foreigners actually use

There are three mainstream structures, each a different trade-off.

Hak Pakai (Right to Use) is the closest a foreign individual gets to title in their own name. It is available to foreigners holding a residence permit (KITAS or KITAP), under Government Regulation No. 18 of 2021, and granted for a defined, extendable term. HGB via a PT PMA. Hak Guna Bangunan (Right to Build) is held not by you but by an Indonesian foreign-investment company (PT PMA) that you own. The company holds the building right; you hold the company. Its link to visas is covered in our foreign ownership, KITAS and PT PMA overview.

Leasehold (Hak Sewa). You do not own the land; you hold a long lease, typically 25 to 30 years, usually with a contractual right to extend. The extension is contractual, not automatic in law, so the extension clause is where the value sits.

The nominee trap

The fourth "route" deserves the most caution: registering an SHM property under an Indonesian "nominee," with a side agreement meant to hand control back to the foreigner.

Be precise here. Indonesian agrarian law does not recognise nominee ownership of land, and Indonesian courts have repeatedly ruled such side arrangements void, so the paperwork meant to protect the foreigner may not hold when tested. If a deal only works as a nominee arrangement, that is a signal, not a shortcut. What to check before you sign

  • Which certificate am I getting: SHM, HGB, Hak Pakai, or a lease? Get it in writing.
  • Whose name is on it? If the answer involves a nominee, take independent advice.
  • On leasehold, how many years remain today, and what does the extension clause promise, at what cost?
  • Is the land zoned for your use (residential versus tourism/commercial for daily rentals)?
  • Engage an independent notaris (notary) to verify the certificate at the land office.

Is it possible to buy freehold in Bali as a foreigner?
