1. Agreement

These Terms of Service ("Terms") form a binding agreement between ANTEYA COMPANY LIMITED, a Hong Kong private company limited by shares, Business Registration Number 76493770, with registered office at Unit 1603, 16th Floor, The L. Plaza, 367โ€“375 Queen's Road Central, Sheung Wan, Hong Kong 999077 ("Anteya", "we", "us", "our"), and any individual or entity ("you", "User") who accesses or uses anteyac.com or any subdomain we operate (the "Website") or who interacts with us through the forms, messengers or communication channels published on the Website (together, the "Services").

By accessing or using the Website or Services, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Website.


2. Who we are

Anteya is a brand operated through two legal entities:

  • ANTEYA COMPANY LIMITED (Hong Kong) โ€” operator of this Website, responsible for online marketing, CRM and international communications. This is the party contracting with you under these Terms.
  • PT ANTEYA REAL ESTATE (Indonesia) โ€” provides on-the-ground services in Bali (viewings, liaison with developers, notary coordination). Any engagement for on-the-ground brokerage/advisory services will be governed by a separate written engagement letter between you and PT Anteya Real Estate, not these Terms.

3. Services we provide

Through the Website we make available general information about real estate projects in Bali, Indonesia, including listings, project descriptions, market content, and contact channels that allow you to request further information or a viewing. Where you request it, we may:

  • share additional information about a property or a developer;
  • arrange a viewing with PT Anteya Real Estate on the ground;
  • introduce you to a developer, a notary (PPAT), a lawyer or a tax adviser;
  • provide informal commentary on the Bali property market as a matter of general discussion.

Our remuneration comes from a commission paid to us by the developer if you ultimately acquire a property. You do not pay us any fee for using the Website or for our introductory services, unless we expressly agree a separate paid engagement with you in writing.


4. Services we do NOT provide

For the avoidance of doubt, Anteya does not:

  • (a) act as an escrow agent or custodian of client funds;
  • (b) accept, hold or transfer any purchase monies โ€” you pay the developer or seller directly into their own bank account;
  • (c) provide investment, legal, tax, accounting, notarial or immigration advice โ€” any statement we make on these topics is general information only and you must obtain independent qualified advice before making any decision;
  • (d) guarantee, warrant or represent any rental yield, capital appreciation, occupancy rate, return on investment, exit value or resale price;
  • (e) act as a licensed financial adviser, securities broker, insurance broker or banking institution in any jurisdiction;
  • (f) provide rental management, property management, short-stay operation or any post-purchase asset management services;
  • (g) provide services that are restricted by Indonesian law to Indonesian-licensed real estate professionals (such acts are performed by PT Anteya Real Estate and/or its licensed partners, not by Anteya).

5. Eligibility

By using the Website you represent and warrant that: (a) you are at least 18 years old and have full legal capacity to enter into these Terms; (b) you are not located in, or a national of, a jurisdiction subject to comprehensive sanctions that would prohibit us from dealing with you; (c) the information you provide to us is accurate, current and complete; and (d) you are not acting on behalf of a sanctioned person or using Anteya to evade sanctions, launder proceeds of crime or finance terrorism.


6. Use of the Website

You may use the Website only for lawful, personal, non-commercial purposes related to your genuine interest in Bali real estate. You agree not to:

  • copy, scrape, harvest or republish content from the Website, in whole or in part, without our prior written consent;
  • use any automated means (bots, crawlers, scrapers) to access the Website beyond normal search-engine indexing;
  • reverse-engineer, decompile or attempt to extract source code from the Website;
  • introduce malware, trojans, worms or harmful code;
  • attempt to gain unauthorised access to any part of the Website, account, server, or network connected to it;
  • impersonate any person or entity or misrepresent your affiliation;
  • use the Website in violation of any applicable law or regulation.

7. Listings and property information

All listings, images, floor plans, renderings, specifications, prices, availability, completion dates, yield estimates and other information displayed on the Website are provided by third-party developers or sellers and are published by us "as-is" for informational purposes only.

We make reasonable efforts to verify material accuracy but we do not warrant that any such information is accurate, complete, current, or free of error. Prices, availability and specifications may change without notice. Visualisations (renderings, 3D models, interior visuals) are artistic impressions and may differ from the delivered property.

Before making any decision to acquire a property you must: (a) personally inspect the property (or arrange an inspection through a representative); (b) obtain an independent legal due-diligence report from a qualified Indonesian lawyer; (c) verify the land title and any encumbrances; (d) obtain independent tax advice in your country of residence and in Indonesia; and (e) obtain a written sale-purchase contract reviewed by your lawyer.


8. No investment, legal or tax advice

Nothing on the Website or in any communication from Anteya constitutes investment advice, a recommendation, a solicitation, an offer to sell or buy securities, a legal opinion or tax advice. Indonesian property investment carries material risks, including but not limited to risks relating to title, zoning, permits (PBG / SLF), changes in law, currency fluctuation, political and regulatory risk, illiquidity, developer solvency, construction delays and force majeure.

Foreign nationals generally cannot hold freehold title (Hak Milik) to land in Indonesia and typically use Hak Guna Bangunan (HGB) through a PT PMA, Hak Pakai, or leasehold structures โ€” each with its own legal and tax consequences. You must obtain independent Indonesian legal advice before proceeding.


9. Bali real estate โ€” specific risk disclosures

Without limitation, you acknowledge and accept that:

  • (a) the Indonesian regulatory environment for foreign real estate investment continues to evolve and retroactive changes may occur;
  • (b) off-plan (pre-construction) purchases carry additional risks of delay, specification changes, default and non-completion;
  • (c) rental yields quoted by developers are projections based on assumptions that may not materialise โ€” actual yields may be lower or negative;
  • (d) tourist-rental operations on Bali are subject to local permits (Pondok Wisata or equivalent) and may be restricted in some zones;
  • (e) the Bali property market is illiquid compared to major urban real estate markets and exit may take longer than anticipated;
  • (f) exchange-rate risk between IDR and your home currency may materially affect returns;
  • (g) any tax calculations shown (BPHTB, PPh, PPN, PBB) are indicative only and depend on final transaction structure;
  • (h) due diligence on the developer's track record and the land title is your responsibility, undertaken with your independent legal counsel.

10. Commissions and fees

The Website and the introductory services described in Section 3 are free of charge to you. Anteya is remunerated by the developer on the basis of a separate commission arrangement. This commission is paid to us by the developer and does not increase the price you pay. If in a specific case we agree a paid advisory engagement with you, this will be documented in a separate written engagement letter specifying scope, fees and invoicing entity (PT Anteya Real Estate or Anteya Company Limited, as applicable).


11. KYC / AML

Where Indonesian anti-money-laundering law (UU No. 8/2010 and implementing regulations), the developer, a notary or a banking counterparty requires it, we may request from you identification documents, proof of address, source-of-funds declarations and tax-residency information. You agree to provide truthful and complete information. We may refuse or terminate engagement with any person who does not provide required KYC information, who provides false information, or whom we reasonably suspect of sanctions, money-laundering or terrorist-financing activity.


12. Intellectual property

The Website, including its design, layout, text, graphics, logos, trade marks, software and compilation of content, is owned by Anteya Company Limited or its licensors and is protected by copyright, trade-mark and other intellectual property laws. The "Anteya" brand and logo are trade marks of Anteya Company Limited.

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and view the Website for your personal, non-commercial use only. All other rights are reserved. In particular you may not extract, copy, republish, frame, or use our content to train any artificial intelligence model without our prior written consent.

Third-party materials (developer logos, project renderings, photographs) are used under licence from the respective rights-holders and remain their property.


13. User content

If you submit information to us (enquiry messages, property preferences, feedback), you grant us a worldwide, royalty-free, non-exclusive licence to use that information to provide the Services, operate our business, and comply with legal obligations. You represent that you have the right to submit such content and that it does not infringe any third-party rights. Personal data is handled under the Privacy Policy.


14. Third-party sites and parties

The Website may contain links to third-party sites (developers, notaries, messaging platforms, social media). We do not control and are not responsible for the content, practices, products, or services of any third party. Your interactions with developers, notaries and other third parties are solely between you and them. Anteya is not a party to any sale-purchase or lease agreement you conclude with a developer or seller.


15. Disclaimers

To the maximum extent permitted by applicable law, the Website and the Services are provided "AS IS" and "AS AVAILABLE", without warranty of any kind, express or implied, including without limitation the implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, completeness, or uninterrupted availability.

We do not warrant that: (a) the Website will be secure, uninterrupted or error-free; (b) any information on the Website is accurate, current or complete; (c) any property you consider will be available at the displayed price or specifications; (d) any projected yield or return will be realised; or (e) any developer or counterparty will perform its obligations.


16. Limitation of liability

To the maximum extent permitted by applicable law:

  • (a) Anteya shall not be liable for any indirect, incidental, special, consequential, exemplary or punitive damages, or for any loss of profits, revenue, business opportunity, rental income, capital appreciation, goodwill, data, or anticipated savings, whether arising in contract, tort (including negligence), statute or otherwise, and whether or not Anteya has been advised of the possibility of such damages;
  • (b) Anteya's aggregate liability arising out of or in connection with these Terms, the Website and the Services shall not exceed one thousand United States dollars (USD 1,000);
  • (c) nothing in these Terms excludes or limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot be excluded or limited under applicable law.

If you are a consumer resident in the European Economic Area, the United Kingdom or another jurisdiction whose mandatory consumer-protection laws grant you rights that cannot be waived, nothing in this Section affects those rights.


17. Indemnification

You agree to indemnify, defend and hold harmless Anteya, its affiliates (including PT Anteya Real Estate), and their respective directors, officers, employees and agents, from and against any third-party claim, damage, loss, liability, cost or expense (including reasonable legal fees) arising out of or in connection with: (a) your breach of these Terms; (b) your misuse of the Website; (c) your violation of any law or third-party right; or (d) information you submit that is inaccurate, misleading or unlawful.


18. Termination

We may suspend or terminate your access to the Website at any time, with or without notice, if we reasonably believe that you have breached these Terms, that continued provision of the Services would violate applicable law, or for any other legitimate reason. Sections 4, 7โ€“9, 12, 15โ€“17, 19 and 20 survive termination.


19. Governing law and dispute resolution

19.1. Governing law

These Terms and any non-contractual obligation arising out of or in connection with them are governed by the laws of the Hong Kong Special Administrative Region.

19.2. Arbitration

Any dispute, controversy, difference or claim arising out of or relating to these Terms, including their existence, validity, interpretation, performance, breach or termination (a "Dispute"), shall be referred to and finally resolved by arbitration administered by the Hong Kong International Arbitration Centre (HKIAC) under the HKIAC Administered Arbitration Rules in force when the notice of arbitration is submitted. The seat of arbitration is Hong Kong. The tribunal shall consist of one arbitrator. The language of arbitration is English.

19.3. Consumer carve-out (EU/UK/EEA residents)

If you are a consumer domiciled in the European Economic Area, the United Kingdom or Switzerland, you retain the benefit of any mandatory consumer-protection rules of the country of your habitual residence. Nothing in Sections 19.1โ€“19.2 deprives you of rights under such mandatory rules, nor restricts your right to bring proceedings in the courts of your place of habitual residence where applicable consumer law so provides. The European Commission provides an online dispute resolution platform at https://ec.europa.eu/consumers/odr.

19.4. Injunctive relief

Notwithstanding the above, Anteya may seek injunctive or equitable relief in any court of competent jurisdiction to protect its intellectual property or confidential information.


20. Changes to these Terms

We may amend these Terms from time to time. Material changes will be posted on the Website and, for registered users or subscribers, notified by e-mail at least 14 days before they take effect. Your continued use of the Website after the effective date constitutes acceptance of the revised Terms.


21. Miscellaneous

  • Entire agreement. These Terms and the documents they refer to (Privacy Policy, any engagement letter) constitute the entire agreement between you and Anteya regarding the Website and supersede any prior understandings.
  • Severability. If any provision is held invalid or unenforceable, the remaining provisions remain in full force.
  • No waiver. Failure to enforce any right is not a waiver of it.
  • Assignment. You may not assign these Terms without our written consent. We may assign these Terms to an affiliate or to a successor in a merger, acquisition or sale of assets.
  • Notices. Notices to Anteya shall be sent to office@anteyac.com with a copy to the registered office. Notices to you may be sent to the e-mail you provided.
  • Force majeure. Neither party is liable for failure to perform caused by events beyond its reasonable control (natural disasters, war, civil unrest, epidemic, governmental action, infrastructure failure).
  • Language. The English-language version of these Terms prevails over any translation in case of discrepancy.
  • No agency. Nothing in these Terms creates a partnership, joint venture, employment, agency or fiduciary relationship between you and Anteya.
