What Is the BPN? Indonesia's Land Office and Your Certificate (2026)

The BPN is the Badan Pertanahan Nasional, Indonesia's National Land Agency, which sits under the Ministry of Agrarian Affairs and Spatial Planning (ATR/BPN). It maintains the national land registry and issues or records the certificates (Hak Pakai, HGB, SHM) that evidence a right over a plot of land. Your title only becomes real once it is registered at the BPN. Until then, a signed contract is a promise, not a proven right.
That distinction is the single most useful thing a foreign buyer in Bali can grasp before wiring money. Across the 5,308 buyer conversations Anteya logged with Bali buyers between 2023 and 2026, one pattern showed up early: buyers asked what land title a villa was sold under before almost anything else.

What the BPN is and what it does
The BPN keeps Indonesia's land books. Each regency and city has a local land office (Kantor Pertanahan) that registers, measures, and issues certificates for land inside its boundary; in Bali the Badung, Gianyar, Tabanan and Denpasar offices cover most districts foreign buyers care about. It records who holds which right over each parcel, issues the certificates, and holds the cadastral map that fixes plot boundaries.
Indonesian law recognises several right types, not a single Western-style freehold. Hak Milik (SHM) is the strongest ownership right and, under Indonesian agrarian law, is generally reserved for Indonesian citizens. Hak Guna Bangunan (HGB) is a right to build and use, typically held by Indonesian companies including a PT PMA. Hak Pakai is a right to use, most often discussed for foreign individuals who hold the appropriate Indonesian residence status. Each is registered at, and evidenced by a certificate from, the BPN.
Why it matters: an unregistered certificate is not security
A notarial deed of sale, a brochure that says "leasehold 25 + 25," and money already paid can all exist while the register still shows someone else as the rights holder. Indonesian agrarian law treats the registered right as the reference point, so the BPN book carries more weight than a private contract.
Anteya observation: In roughly a quarter of the title-related conversations we logged, the buyer had a price, a floor plan and a payment schedule long before anyone had confirmed the certificate at the land office. The commercial detail arrives first; the registration check, which is the actual security, arrives late or not at all. That order is backwards.

Freehold in the Western sense maps onto Hak Milik, which foreign individuals generally cannot hold directly. That is why so many Bali deals are structured as leasehold or Hak Pakai, and why the certificate type on the register matters more than the marketing word "freehold." How a title gets registered: deed to BPN to certificate
A licensed notary (notaris) or land deed official (PPAT) drafts and signs the deed of transfer, commonly the Akta Jual Beli (AJB) for a sale, then lodges it with proof of tax payment and identity documents at the local BPN office. The BPN checks the file, updates the register, and issues or amends the certificate in the new holder's name.
Two points buyers miss. The gap between signing the AJB and the reissued certificate can run weeks or months, and the register may still name the previous holder meanwhile. And on off-plan land a developer often holds the parent certificate while the buyer holds a lease or use right carved out of it, so the name on the register may legitimately differ from the one you expect.

On leasehold, an extension is a contractual right you negotiate with the landowner and register, not something the certificate grants by default. Treat the years remaining and the extension terms as facts to verify against documents.

How to verify a certificate at the BPN before you buy
You do not need to take the seller's word for it. The first step is the "cek sertifikat" feature in the official Sentuh Tanahku app or the ATR/BPN web portal, which confirms a certificate number exists and matches the stated holder and parcel. Beyond that, a notary or PPAT can run a formal certificate check (pengecekan sertifikat) at the local land office, cross-referencing the physical certificate against the register and flagging any encumbrance, dispute or overlap. For any real purchase, pay for that formal check; it is cheap relative to the risk it removes.
Confirm four things: the certificate number is real, the right type matches what you were told, the boundaries and area match the plot, and no mortgage (Hak Tanggungan) or caveat sits on the title. Common mistakes buyers make
The recurring errors are simple and expensive. Buyers accept "freehold" as a legal fact rather than a marketing label. They pay a deposit before any certificate check. They rely on a screenshot without confirming it against the live register. They assume a leasehold extension is settled when it is only spoken about. And they skip the notary's formal check to save a small fee, then find an encumbrance after transfer.

The through-line is timing: the certificate check belongs before the deposit, not after. A buyer who makes a BPN check a condition of paying loses nothing if the title is clean and avoids a serious problem if it is not.
